Though he tried to return to his legal career in New York, he found himself in constant demand for speeches, parades, and honorary degrees. The pressure seemingly too much for him Whittlesey committed suicide on November 26, 1921 by jumping overboard while traveling on the SS Toloa out of New York en route to Havana.
